Section 242 BNS
Section 242 of the Bharatiya Nyaya Sanhita (BNS) deals with “False personation for purpose of act or proceeding in suit or prosecution”. It states:
“Whoever falsely personates another, and in such assumed character makes any admission or statement, or confesses judgment, or causes any process to be issued or becomes bail or security, or does any other act in any suit or criminal prosecution, shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both.”
In other words, impersonating someone else for the purpose of making admissions, confessing judgment, issuing legal processes, providing bail or security, or performing any other act in a civil or criminal case is punishable by up to 3 years imprisonment, a fine, or both.
Section 242 falls under CHAPTER XIV OF FALSE EVIDENCE AND OFFENCES AGAINST PUBLIC JUSTICE in the BNS 2023 Act. It aims to prevent abuse of legal processes through false personation.
